Additional Clause for Allurion Gastric Balloon Medical Procedures

Swallowing Risk and Procedure Attempts

The Allurion Gastric Balloon placement involves swallowing a capsule under the guidance of a trained medical professional. While this procedure is safe and highly effective for the majority of patients, there are inherent risks associated with the placement, as outlined in medical studies, including the rare inability to swallow the capsule even with professional assistance.

  • Initial Placement and Attempts:

    • The clinic will make two attempts to successfully place the gastric balloon, either through the patient swallowing the capsule naturally or with the assistance of a medical professional using a stylet for guidance.

    • According to clinical studies, approximately 35.9% of patients require a stylet to aid in swallowing, and less than 0.1% are unable to successfully swallow the capsule, even with this assistance.

  • 2.A Patient Responsibility and Acknowledgment of Risk:

    • By agreeing to the procedure, the patient acknowledges and accepts the inherent risk of being unable to complete the placement despite professional assistance.

    • If the capsule placement fails during both attempts, the patient understands that this outcome is not due to negligence on the clinic's part but rather a physiological limitation.

  • Rescheduling Policy for Failed Placements:

    • If the initial placement session is unsuccessful, the patient is eligible to reschedule up to two additional sessions. These sessions will include new attempts with the use of a second Allurion Gastric Balloon.

    • Only two gastric balloons will be allocated to the patient. Should placement remain unsuccessful after two sessions, no further attempts will be permitted, and the patient forfeits the procedure.

    • The cost of the gastric balloons and related services will not be refunded under these circumstances, as this outcome is part of the acknowledged risk.

  • Policy on Rescheduling and Balloon Usage:

    • The clinic’s team will coordinate with the patient to schedule the rescheduled attempts within the available time slots.

    • All attempts will be conducted in accordance with medical standards to maximize success while ensuring patient safety.

  • Medical Team Expertise:

    • The procedure will be conducted by an experienced medical professional, and all necessary measures will be taken to ensure patient comfort and success during the placement.

  • Finality of Attempts:

    • After the two additional sessions and the use of two gastric balloons, if the patient is still unable to complete the procedure, the clinic's obligation to the patient is deemed fulfilled. No further placements or refunds will be provided.

Important information to consider before the placement of an Allurion Gastric Balloon

  • The Allurion Gastric Balloon is part of a behaviour modification programme that lasts for a minimum of 6 months, to which you must be fully committed. This device is designed to promote weight loss, but only by committing to changing your eating habits and increasing your physical activity will you be able to achieve and maintain a healthy weight in the long term.

  • It is important to note that the Allurion Gastric Balloon may cause adverse events, some of which may require removal by endoscopy. Rare cases of spontaneous hyperinflation, small intestine obstruction, stomach dilation, oesophagitis, pancreatitis, or stomach perforation have been reported, requiring surgical intervention.1,4 Please consult the full list of potential complications available on the page Important Safety Information.

  • The Allurion Gastric Balloon is not suitable for all patients. Pregnant individuals or those with a history of oesophageal or stomach surgery, among others, are not eligible for the procedure. The complete list of contraindications can be found in the device's instructions for use provided to doctors. Your doctor will review your medical history and conduct a physical examination to confirm your eligibility for the Allurion Programme.

  • It is crucial that each doctor and patient carefully assess the risks and benefits of the treatment before using the Allurion device. To learn more about the Allurion Balloon, its effectiveness, and its tolerability, discuss it with your doctor.

  • You must be available for follow-up with our medical team throughout the treatment period, especially if you experience the following symptoms, including but not limited to: persistent nausea, vomiting, dehydration, and/or abdominal pain. If you consult other healthcare professionals, inform them that an intragastric balloon is present. We encourage you to stay close to modern emergency care facilities during the time the balloon is in place, in case serious complications arise.

*** Financing, Medical Device Ownership, and Non-Refundability Clause

All financing agreements, medical procedures, and device purchases facilitated by Rapid Access Medical Tourism (RAMT), RapidCare Logistics Corp., SlimRestore, or any affiliated entities are strictly non-refundable once initiated.

This applies to all medical devices, equipment, treatments, surgical procedures, or special medical programs that have been approved, scheduled, or delivered in whole or in part.

By proceeding with a booking, purchase, or financing arrangement, the patient acknowledges and agrees to the following:

  • Third-Party Financing Agreements

    • Patients who obtain financing through an external or third-party lender (e.g., Beautifi, iFinance, LendCare, Credit Cards Loans or similar) are entering into a separate and binding loan contract with that lender.

    • The loan obligation is between the patient and the financing institution, not the clinic, its affiliates, or its medical partners.

    • RAMT and its affiliates have no legal authority or ability to modify, cancel, or interfere with any financing agreement once approved and funded.

    • Any loan repayments, cancellations, or disputes must be addressed directly with the financing provider as per their independent terms and conditions.

  • Ownership and Non-Return of Medical Devices

    • All medical devices (including but not limited to the Allurion Gastric Balloon, diagnostic materials, or surgical implants) are classified as personalized medical products under applicable healthcare and safety regulations.

    • Once a device has been assigned, shipped, or prepared for an individual patient, ownership transfers to the patient, and it cannot be resold, reassigned, reused, or returned for safety, hygiene, and medical compliance reasons.

    • Refunds or cancellations on medical devices are strictly prohibited once procurement or preparation has begun.

  • Non-Refundable Procedures and Services

    • Due to the clinical nature of the services, significant pre-scheduling, physician allocation, and material preparation, no refunds will be issued after booking confirmation or partial service delivery.

    • Patients who choose not to proceed after booking are not eligible for refunds under any circumstance; however, RAMT remains committed to assisting patients whenever possible and may, at its discretion, offer alternative options, such as a credit transfer toward another approved medical program, treatment, or to an eligible family member or friend. These options are provided as a gesture of goodwill to help patients continue their care journey in the most suitable way.

  • Legal and Financial Acknowledgment

    • The patient acknowledges that all medical services and devices are rendered in compliance with federal and provincial healthcare standards and therefore exempt from traditional return or refund policies applicable to retail transactions.

    • The patient further agrees that all payments, deposits, and financed amounts are final and non-reversible, and that they will not initiate chargebacks, disputes, or claims inconsistent with these terms.

In summary:
Once a procedure, financing, or medical device order has been confirmed or initiated, no refunds, reversals, or cancellations will be granted for any reason, except as expressly required by law.

This clause is intended to ensure regulatory compliance, protect patient safety, and maintain the integrity of the medical and financial processes involved.
